I have only just discovered that Cox have a website, yes THAT Cox,

They seem to be producing a number of RTF models, and the blurb on the page states that they are the same Cox who made all the stuff in the 50s & 60s
Am I the only person who didn't know that Cox still exist?

Yes, Estes/Cox was purchased by Hobbico and what you see are basically Hobbico electric planes with the Cox name on them.
I have heard nothing recently about their interest in gas-powered engines, but about a year ago they expressed no interest in such a thing.

Yes I did know about this.
In my opinion they are tainting the cox name by just selling re branded nine eagles planes.

Hmmm Wilf,
I have seen them before and I have seen some of those planes at my LHS. Not sure if they are truly Cox but, perhaps have rights to market products under the Cox name.
Maybe Matt or Bernie can shed some light on this.......

That website has been up since 2004 or before. They were the ones that were selling off the Surestarts for 6.99 --- I always looked it as a glowplug with a free engine attached.

I fully agree, but through the purchasing of Estes/Cox Hobbico can basically do whatever they want with what they have the rights to.

They are not the same people/website that were selling the $7 surestart engines. Hobbico bought Estes/Cox in January 2010.
After dealing with their aggressive lawyer about 2 years ago (with the end result of me telling him to go jump in the lake - or a more polite form thereof) I am kind of believing that one of their objectives is to defend the trademark by slapping it onto some product they have.
At last count Hobbico had zero interest in making anything Cox that is gas engines.

Oh they saw that and that is why zeroed in on us.
I don't want to get specific but what I last said to them made them back off and leave me alone.
However, because I would not acquiesce to their demands they said they would not license me for distribution. I nearly fell off my chair laughing.

First sale and exhaustion in the USA
I found this off some website somewhere. Not sure about Canadian laws or Bernies arrangements I know He's in business so i guess all is kosher
In the USA, the trademark holder cannot act against domestic resellers of products he put on the market himself. The same applies if the product was manufactured by a third party with permission of the trademark holder (a licensee). This is called the "first sale" doctrine. The idea behind it is that the trademark holder has had a chance to ensure the quality of the product and to make money of the first sale, and then he no longer has a right to control further distribution of that product. Of course it only applies to the particular products he put on the market, making an exact copy of that product and selling that is trademark infringement.
So said the website. All that is just a bunch of legal mumbo jumbo I don't understand
